Legal Implications and Safety Measures

You’re walking to grab coffee, the sun’s out, and everything’s good — until you get to an intersection with no crosswalk and no pedestrian crosswalk sign. You stop and think, “Do I wait or just go?” Even though Connecticut laws protect pedestrians where there isn’t a marked crosswalk and no pedestrian signal, it’s a potentially dangerous choice: cross or continue down the sidewalk to find a marked crosswalk?

What is the role of crosswalks in determining liability?

Crosswalks are much more than lines painted on the pavement. They are extremely important to the safety of pedestrians and also play a very significant role in legal cases involving serious pedestrian collisions. When a pedestrian is struck by a vehicle while in a marked crosswalk, it is very difficult, even for Big Insurance, to fight the case for compensation.

It can become much more complicated when there is no crosswalk. If a pedestrian is hit while crossing in an unmarked area, the driver may argue that the pedestrian was jaywalking, which could place some or all of the liability on the victim. Other factors, such as lighting and if the pedestrian is wearing dark clothing, can bear on liability, but crossing outside of a marked crosswalk automatically sets up a fight with Big Insurance.

How does crossing in a crosswalk influence compensation?

Severe pedestrian accidents produce tremendous healthcare expenses, lost income, and pain and suffering that can persist for a long time. The presence of a crosswalk can significantly impact the amount of compensation awarded. In cases where the pedestrian is within a crosswalk, the path to full compensation is more straightforward. The law recognizes the pedestrian’s right to safety, and any breach of this right by a driver can lead to higher compensation for medical bills, rehabilitation costs, lost income, pain and suffering, and emotional distress.

Crossing outside of a crosswalk or in an area that is not an intersection will make winning your maximum compensation more of a challenge, but it can be done! The injured pedestrian has to prove that the driver’s negligence was the direct cause of the accident. This often requires extensive evidence, including witness statements, traffic camera footage, and expert testimony.

What are the key safety measures for pedestrians and drivers?

Pedestrians

  • Always cross the street at designated crosswalks and intersections. It might take a few minutes longer, but it greatly increases your safety.
  • Wear bright or reflective clothing, especially during low-light conditions. Ensure drivers can see you from a distance.
  • Follow pedestrian signals and wait for the “walk” sign before crossing. Make eye contact with drivers to ensure they see you.
  • Always be aware of your surroundings. Avoid distractions such as smartphones when crossing the street.

Drivers

  • Always yield to pedestrians at crosswalks and intersections. Remember, they have the right of way.
  • Slow down in areas with high pedestrian traffic, especially near schools, parks, and shopping centers.
  • Avoid distractions while driving. Keep your attention on the road and be prepared to stop for pedestrians.
  • Obey all traffic signals and signs, and be extra cautious when turning at intersections.
